Terms of Service
Who you are dealing with

What these terms cover
They apply to this website and to every OptiTools application you buy here: OptiMac, OptiSound, OptiLoad, OptiTube and anything listed under OptiExtras. If you do not accept them, do not buy or use the software.
How a purchase works
Prices are shown in euro and include VAT where it applies. You pay through PayPal, and the contract comes into being when PayPal confirms the payment. Delivery is a download link, immediately, on the confirmation page. There is no physical product and no shipping.
Your licence
You get a personal, non-exclusive licence to use the app on Macs you own or control, for as long as you like. A lifetime licence means exactly that: one payment, no subscription, no expiry.
You may not resell, rent out, sublicense or redistribute the software, share licence material publicly, or remove copyright notices. You may not decompile or reverse engineer it beyond what §§ 69d and 69e UrhG allow. Copyright in the software stays with us.
Right of withdrawal
As a consumer in the EU you have 14 days to withdraw from a purchase, without giving a reason. For digital content delivered immediately, that right ends once you have expressly agreed to immediate delivery and acknowledged that you lose the right of withdrawal by doing so (§ 356(5) BGB).
In practice: if you have downloaded the app after agreeing to immediate delivery, the withdrawal right is gone. If you have not, write to info@optitools.org within 14 days of purchase and we will refund you in full. If an app is broken on your machine and we cannot fix it, write to us anyway and we will sort it out rather than argue.
Requirements and updates
The system requirements on each app page are part of what you are buying. Apple Silicon and the stated minimum macOS version are required. Updates for the version you bought are provided at our discretion and we do not promise a release schedule.
Third-party services
Some apps display or work alongside services run by other companies, such as YouTube, YouTube Music, YouTube Studio, Twitch and Last.fm. We are not affiliated with, endorsed by or sponsored by any of them, and all trademarks belong to their owners. Your use of those services remains subject to their own terms and can change or stop without notice from us. You are responsible for using them lawfully and in line with their terms.
Warranty
Your statutory rights for digital products under §§ 327 ff. BGB apply in full. We do not promise the software is free of every fault or fits a purpose you have in mind that is not described on the site.
Liability
We are liable without limit for intent and gross negligence, and for injury to life, body or health. For slight negligence we are liable only where we breach an obligation essential to the contract, and then only for foreseeable damage typical of this kind of contract. Liability under the German Product Liability Act is unaffected. Back up your data before running any tool that changes your system.
Law and disputes
German law applies. If you are a consumer, this does not remove the protection of mandatory law in your country of residence. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
Changes
We may update these terms for future purchases. The version published when you bought is the one that governs your purchase.
