Terms of Service
These Terms of Service (“Terms”) govern your access to and use of OptiCord, including the OptiCord application, beta and prerelease builds, updates, support and feedback channels, related websites, and any associated services we provide (together, the “Services”).
OptiCord is published by OptiTools Architecture, proprietor Lukkas von Kleist, Viktoriastraße 2, 80803 München-Schwabing-Freimann, Germany (“OptiTools”, “we”, “us” or “our”). Contact: info@optitools.org.
By downloading, installing, accessing or using the Services, you agree to these Terms. If you do not agree, do not use OptiCord.
1. Eligibility
You may use OptiCord only if you are old enough to use Discord in your country and otherwise permitted to use Discord under Discord’s rules. Discord currently requires users to be at least 13 and applies higher minimum ages in some countries.
If you have not reached the age at which you can enter into these Terms on your own, a parent or legal guardian must agree to them on your behalf.
If you use OptiCord for an organisation, you confirm that you have authority to accept these Terms for that organisation.
2. Independent project; no affiliation with Discord
OptiCord is an independent third-party client. It is not affiliated with, authorised by, sponsored by, approved by or endorsed by Discord Inc. or any Discord affiliate.
Discord is a separate third-party service. Discord names, trademarks, logos and other assets remain the property of their respective owners.
Your use of Discord remains subject to Discord’s own terms, policies, safety rules and account restrictions. These Terms do not replace or modify your agreement with Discord.
You must not use OptiCord to bypass a Discord warning, suspension, ban, age restriction, privacy or safety control, rate limit, or other enforcement measure.
Discord can change its services, APIs, authentication systems, media systems, policies or technical interfaces at any time. Those changes may impair or prevent OptiCord from working. We are not responsible for Discord’s decisions or enforcement actions.
3. Licence to use OptiCord
Subject to these Terms, we grant you a personal, limited, non-exclusive and non-transferable licence to install and use the proprietary parts of OptiCord for lawful purposes on the Mac on which your licence is activated. One purchase covers one Mac (section 16). The licence has no expiry date and ends only as described in section 13.
This licence does not transfer ownership of OptiCord, its source code, design, branding, documentation or other intellectual property.
Components distributed under an open-source licence are governed by that licence. If an open-source licence gives you rights that conflict with these Terms, the open-source licence controls for that component.
4. Proprietary software and technical protections
Except where mandatory law or an applicable open-source licence expressly allows it, you must not copy, sell, sublicense, redistribute or publish proprietary OptiCord builds or private prerelease builds; share or resell licences or activation links; remove ownership notices; circumvent licence, access, signing or security controls; extract or misuse non-public credentials, signing material or secrets; or present a modified build as an official OptiCord release.
Nothing in these Terms limits rights that cannot lawfully be restricted, including rights that may exist under German or EU law for interoperability, security research or lawful analysis.
5. Acceptable use
Use OptiCord lawfully and responsibly. You must not use the Services to:
- violate law, a court order, or another person’s rights;
- violate Discord’s terms, policies or safety rules;
- operate self-bots, spam tools, raid tools, credential stealers, token loggers or unauthorised automation;
- access another person’s account, device, communications or data without permission;
- collect, expose, sell or misuse passwords, authentication tokens, personal data or private communications;
- phish, defraud, impersonate, harass, threaten or exploit another person;
- distribute malware, spyware or malicious code;
- circumvent rate limits, security controls, age restrictions, moderation controls or enforcement measures;
- interfere with the availability, integrity or security of OptiCord, Discord or another system;
- scrape, archive or commercially exploit data without the permission required by law or the relevant service terms; or
- help another person do any of the above.
6. Accounts, credentials and device security
You are responsible for securing your Mac, your Discord account, your email account, and any credentials or session information stored on your device.
Do not share authentication tokens, recovery material, activation links or private beta access with people who are not authorised to use them.
If you believe your account, device or OptiCord session has been compromised, secure the affected account through the relevant provider and contact us if OptiCord-specific action is needed.
7. Beta and prerelease software
OptiCord may be distributed as alpha, beta, experimental, private or prerelease software. Prerelease software can contain bugs, unfinished features, compatibility problems or security defects, and features may change or disappear before release.
Back up important data before testing prerelease builds. Do not rely on a beta build for emergency, medical, safety-critical, financial or other high-risk use.
Private builds are provided only to authorised testers. Unless we say otherwise in writing, you may not redistribute, sell, mirror or publicly post a private build or its private download link.
8. Updates, availability and compatibility
OptiCord checks for updates automatically and offers them in the app. We may require a newer build for continued use where an older build is incompatible, insecure or no longer supported.
We may add, change, remove, suspend or discontinue features. We do not promise a particular release date, roadmap item, feature, integration or period of availability.
We do not guarantee compatibility with every Mac, macOS version, Discord change, server configuration or third-party modification. OptiCord requires a Mac with Apple Silicon and macOS 15 or later.
9. Discord content and local data
Content you access through Discord remains subject to Discord’s systems and policies. Neither OptiCord nor we obtain ownership of your Discord messages, attachments, servers, channels, voice communications or other Discord content merely because the app displays or handles them on your device.
OptiCord may store settings, caches, session information, application state and logs locally on your Mac. You are responsible for your local files, backups and device security.
How we handle personal data is explained in the Privacy Policy.
10. Feedback
If you voluntarily send us a bug report, suggestion, feature request or other feedback, you allow us to use that feedback to develop, improve, document and support OptiCord without owing you compensation.
You keep ownership of unrelated material you include with a report. Personal data included in support or feedback submissions is handled under the Privacy Policy.
11. Intellectual property and branding
We and our licensors retain the rights we hold in the proprietary software, documentation, artwork, interface designs, names and branding.
You may not use the OptiCord or OptiTools name, logo or confusingly similar branding to impersonate us, suggest an endorsement or affiliation that does not exist, or distribute an unauthorised build as official software.
12. Third-party services
OptiCord depends on third-party services, especially Discord. Some features use other providers, for example GIPHY for GIF search and Pinterest for image search. Those services are operated independently and may change, restrict or discontinue access without notice from us.
Where OptiCord links to, displays or interacts with another provider, your use of that provider remains subject to its own terms and privacy policy. We do not control its independent security, availability or moderation decisions.
13. Suspension and termination
You may stop using OptiCord at any time.
We may deactivate a licence or end access to an OptiTools-operated service or private beta where we reasonably believe that you materially breached these Terms, compromised security, abused access, shared or resold a licence or activation link, redistributed a private build without permission, where the payment for the licence was refunded or reversed, or where action is needed to comply with law or protect users or systems.
Ending access does not affect provisions that by their nature should continue, including ownership, licence restrictions, liability, feedback rights and dispute provisions.
14. Warranty
Your mandatory statutory rights are unaffected.
Subject to those rights, OptiCord is provided as described and may contain faults. We do not promise that it will be uninterrupted, error-free, compatible with every Discord change or suitable for a purpose that we have not expressly described.
Where the German rules for digital products in §§ 327 ff. BGB apply, those statutory rights apply in full.
15. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, and where liability cannot legally be limited.
For slight negligence, we are liable only where we breach an obligation essential to the contract and only for foreseeable damage typical of this kind of contract. Liability under the German Product Liability Act remains unaffected.
To the extent permitted by law, we are not responsible for losses caused by Discord outages, Discord enforcement or policy changes, unsupported third-party modifications, your failure to secure your device or credentials, or circumstances outside our reasonable control.
16. Purchase, activation and right of withdrawal
OptiCord is sold as a one-time purchase on www.optitools.org/opticord. The price is shown in euro before you pay and includes VAT where it applies. You pay through PayPal, and the contract comes into being when PayPal confirms the payment.
After payment, the purchase page gives you the download and a one-time activation link. Opening the link on your Mac activates OptiCord on that Mac and creates its licence. One purchase activates one Mac: the same link keeps working on that Mac, for example after a reinstall, and is refused on any other Mac.
OptiCord confirms its licence online each time it starts. If it cannot reach our licence service, it asks you to try again once you are online.
As a consumer in the EU you have 14 days from the purchase to withdraw from the contract without giving a reason. Write to info@optitools.org within that period and we will refund you in full; the licence is then deactivated. Nothing in these Terms removes consumer rights that apply to a digital purchase.
17. Governing law and disputes
German law applies. If you are a consumer, this choice of law does not remove any mandatory protection you have under the law of your country of residence.
We are neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board, unless a legal obligation to do so applies.
18. Changes to these Terms
We may update these Terms when the Services, law, security requirements or our operations change. The current version will state its effective date.
Where a change materially affects an existing purchase or another continuing contractual relationship, we will give notice where the law or the applicable contract requires it. We will not retroactively turn conduct that was lawful under an earlier version into a breach.
19. General
If part of these Terms is invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
A failure to enforce a provision once does not waive the right to enforce it later.
These Terms, the Privacy Policy and any applicable open-source licences form the agreement governing the relevant Services.
